Man spends five nights in jail for 1.5g of marijuana

A young Prince Albert man, caught with a small amount of marijuana, was handed a fine this morning on top of the five days he had already spent behind bars.

Clayton Morin, 24, was arrested Friday during a warrant search on a Prince Albert home by the city’s Integrated Street Enforcement Team. Prosecutor Dan Heffernan said Morin was sitting on the back porch with friends when police arrived, and was found to have 1.5 grams of marijuana in his pocket when he was searched. Morin pleaded guilty to a possession charge this morning after spending the long weekend remanded in the Prince Albert Correctional Centre.

Heffernan said the Crown was seeking a fine in the range of $200, but Morin’s defence lawyer Pamela Cuelenaere said that was too much on top of the time Morin had already spent on remand.

“He was taken into custody on Sept. 1,” Cuelenaere said. “We think that a $200 fine would be excessive.”

Judge Steven Schiefner imposed a fine of $130 and noted that possession of marijuana is still treated as a crime, even with Canada-wide legalization looming on the horizon.

“It may be someday that marijuana is legal,” Schiefner said. “But it’s not today.”
